END-USER LICENSE AGREEMENT FOR WEDITOR DEMO IMPORTANT - READ CAREFULLY: This document is a legal Agreement between you (either an individual or a single entity) and the Creator of Weditor. By signing up for a Weditor Demo, by gaining access to a Weditor Demo account, by downloading, installing, accessing or otherwise using the Weditor software, you agree to be bound by the terms of this agreement. If you do not agree to all the terms of this agreement, do not sign up, access, download, install, or otherwise use the software product on this site.   1. DEFINITIONS: "Evaluation Period" means the period commencing with the date you agree to this license agreement by clicking on the button below and sign up for a Wedior Demo Account. The Evaluation Period ends one (1) month after its commencement. "Weditor Software" refers to all of the code, pictures and accompanying written materials on this web site. The accompanying written materials include the help, screen shots, features and other web pages on this site. "Weditor Demo Account" refers to an account created on this web site that allows access to the Weditor Demo. "Weditor Demo" means the Weditor Software when it is used for evaluation purposes during the Evaluation Period.  "Creator of Weditor" refers to Ilya Rosenberg, the original Creator of the Weditor Software.   2. COPYRIGHT: The Weditor Software and the accompanying written materials on this web site is owned by the Creator of Weditor and is protected by United States and international copyright laws and international trade provisions.   3. GRANT OF LICENSE: Subject to the terms below, the Creator of Weditor hereby gives you non-transferable, non-exclusive access to the Weditor Software solely for your use during the Evaluation Period. THE WEDITOR SOFTWARE IS NOT FAULT TOLERANT AND IS NOT DESIGNED, MANUFACTURED, OR INTENDED FOR USE OR RESALE AS ON-LINE CONTROL EQUIPMENT IN HAZARDOUS ENVIRONMENTS REQUIRING FAIL-SAFE PERFORMANCE, SUCH AS IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, DIRECT LIFE SUPPORT MACHINES, OR WEAPONS SYSTEMS, IN WHICH THE FAILURE OF WEDITOR SOFTWARE COULD LEAD DIRECTLY OR INDIRECTLY TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE. You may not i) reverse engineer, decompile, decrypt, decode, or disassemble the Weditor Software or any copy thereof. ii) modify, or create derivative works based upon the Weditor Software in whole or in part. iii) copy or distribute copies of the Weditor Software.  iv) remove any proprietary notices or labels on the Weditor Software or any copy thereof. v) gain access to the server which hosts the software in ways that are not expressly authorized by this web site and the Creator of Weditor.  vi) resell, lease, rent, transfer, sublicense, or otherwise transfer rights or grant access to the Weditor Software or any copy thereof.  vii) use the Weditor Software to access any account, web site, or ftp server that you were not expressly given access to by this web site and the Creator of Weditor. viii) establish multiple Weditor Demo Accounts.  ix) perform or release benchmarks, comparisons, or evaluations of the Weditor Software without the Creator of Weditor's written prior consent. x) use the Weditor Software for production purposes. xi) examine the internal design or operation of the Weditor Software.    4. TITLE: You acknowledge that no title to the intellectual property in the Weditor Software is transferred to you. Title, ownership, rights, and intellectual property rights in and to the Weditor Software shall remain under the ownership of the Creator of Weditor.   5. UPGRADES: The Creator of Weditor reserves the right to update or upgrade the Weditor Software without giving prior notice.    6. TERMINATION: Without prejudice to any other rights, the Creator of Weditor may terminate this agreement if you fail to comply with the terms and conditions of this agreement. No notice will be required from the Creator of Weditor to effect such termination. Upon termination, you must uninstall and destroy any components of the Weditor Software (together with all modifications and merged portions in any form).   7. DISCLAIMER OF WARRANTY: The Weditor Software Demo is provided to you at no charge. YOU AGREE THAT THE CREATOR OF WEDITOR HAS MADE NO EXPRESS WARRANTIES, ORAL OR WRITTEN, TO YOU REGARDING THE PRODUCT AND THE PRODUCT IS BEING PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND. THE CREATOR OF WEDITOR DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESSED, IMPLIED, OR STATUTORY, INCLUDING, BUT WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NONINFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. ZONE LABS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, COVER, RELIANCE, OR CONSEQUENTIAL DAMAGES (INCLUDING TO, BUT NOT LIMITED TO, LOSS OF ANTICIPATED PROFIT) ARISING FROM ANY CAUSE UNDER OR RELATED TO THIS AGREEMENT.   8. LIMITATION OF LIABILITY: You must assume the entire risk of using the Weditor Software. IN NO EVENT SHALL THE CREATOR OF WEDITOR BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, LOST SAVINGS, LOSS OF INFORMATION, BUSINESS INTERRUPTION, OR OTHER INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF THE USE OF THE WEDITOR SOFTWARE OR THE INABILITY TO USE THE WEDITOR SOFTWARE, EVEN IF THE CREATOR OF WEDITOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL THE CREATOR OF WEDITOR BE LIABLE FOR ANY CLAIM, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY OF LIABILITY. THIS LIMITATION SHALL APPLY TO CLAIMS OF PERSONAL INJURY TO THE EXTENT PERMITTED BY LAW. IN NO EVENT WILL THEk CREATOR OF WEDITOR BE LIABLE FOR ANY DAMAGES RESULTING FROM USE OF THE WEDITOR SOFTWARE THAT WAS NOT EXPRESSLY PERMITTED BY THIS LICENSE AGREEMENT.   9. MISCELLANEOUS: Severability: In the event of invalidity of any provision of this Agreement, the parties agree that such invalidity shall not affect the validity of the remaining portions of this Agreement. Export: You agree that you will not export or re-export the Weditor Software outside of the jurisdiction in which you obtained it without the appropriate United States or foreign government licenses. Governing Law: This agreement will be governed by the laws of the State of New Jersey as they are applied to agreements between New Jersey residents entered into and to be performed entirely within New Jersey. The United Naations Convention on Contracts for the International Sale of Goods is specifically disclaimed. Reservation of rights: All rights not expressly granted in this Agreement are reserved by the Creator of Weditor.   Entire Agreement: You agree that this is the entire agreement between you and the Creator of Weditor, which supersedes any prior agreement, whether written or oral, and all other communications between Weditor and you relating to the subject matter of this Agreement and may only be modified or amended by a written amendment executed by both parties' authorized officers.   If you have any questions about this agreement, you may contact Weditor:
